I thought the trash fee was invalidated by the court.
A court order on Feb. 17, 2007 required the city to stop collection of the trash fee in Fiscal Year 2007, which began July 1, 2006 and ends June 30, 2007.
As part of the settlement with the plaintiffs in the trash fee lawsuit, the court approved the new trash fee program in Fiscal Year 2008, starting July 1, 2007 and ending June 30, 2008. The court has allowed the city to refund or credit fees, which residents had already paid for trash collection in Fiscal Year 2007. This new trash program was established by the Executive Order of the Springfield Finance Control Board.
Springfield homeowners have the option of receiving a refund for any trash fees already paid or having those fees credited towards the new trash fee. Interest that has accrued since the date of the preliminary injunction order, November 20, 2006, will be credited in either situation.
