Warning of Risk

The Springfield Parks Division is committed to providing safe aquatic facilities and holds safety of participants in high regard; however, participants and parents/guardians of minors engaged in aquatic activities must recognize that there is an inherent risk of injury. The very nature of swimming and aquatic activities are hazardous and risky. Despite careful and proper preparation, instruction, medical advice, conditioning and equipment, there is still a risk of serious injury, including but not limited to drowning, head/brain injury, and cervical spine injury. Not all hazards and dangers can be foreseen. Some inherent risks include: fatigue, poor swinging skills, failing to avoid dangerous areas, horseplay, diving in shallow water and striking the bottom or side of the pool, slipping or falling on the deck or within the locker facility, chemical exposure, delay in emergency response time, poor supervision or instruction, lack of conditioning, striking other swimmers, defective or inadequate equipment, and all other circumstances related to aquatic facility use.

Assumption of Risk Permission and Waiver

I certify that I have read this form carefully and understand that by registering my child in the Springfield Parks Division summer pool program, I assume all risks and legal liability connected with my child's participation in the program, and release and waive all claims against the City of Springfield, the Division of Parks, Buildings and Recreation Management, and any of their officials and employees (collectively referred to as the "City"), for personal injuries, including death, property damage or any other loss or claim or expense incurred by myself, my child, or any other person, in any way related to or arising out of my child's participation in this program and any activities related to the program. I further agree to waive and release the City from all claims or losses that I, my minor child, or other person may have, now or in the future, arising out of, or related in any way to my child's participation in the summer pool program. I have read and fully understand the above information, warning of risk, and assumption of risk and waiver language.
